ARTICLE I, Sunset Beach [Adopted 8-18-1987 by Ord. No. 5-1987]
§ 2-1. Title.
This article shall be known and may be cited as the "Sunset Beach Alcohol Consumption Ordinance" of the Borough of Harveys Lake.
§ 2-2. Definitions.
The following words, when used in this article, shall have the meanings ascribed to them in this section, except those instances where the context clearly indicates a different meaning:
ALCOHOL -- Any alcohol or other liquid defined, regulated and/or governed by the Liquor Code, Act of April 12, 1951, P.L. 90, Article I, Section 101 et seq., 47 P.S. § 1-101 et seq., as amended. (Provisions constituting the Liquor Code, consisting of §§ 1-101 to 8-803, were reenacted by Act of June 29, 1987, P.L. 32, No. 14, §§ 1 to 139.)
§ 2-3. Alcohol consumption prohibited.
No person shall be permitted to consume alcohol from any bottle, glass, can, cup or other container upon the public bathing place known as "Sunset Beach" in the Borough of Harveys Lake.
§ 2-4. Violations and penalties.
Any violation or failure to comply with any provision of this article shall constitute a summary offense, and prosecution for every such offense shall be according to the practice in the case of summary convictions. No fine or penalty shall exceed $300 for any single violation of this article. (See 53 P.L. §§ 48301 and 48308.)
